Representative Matters:
- Argonne Bridge Litigation. Counsel to Central Pre-Mix Company with respect to $1 million damage claim made by project subcontractor involving defective concrete pier. Spokane County project.
- Coeur d'Alene Wastewater Treatment Plant. Construction counsel to City of Coeur d'Alene with respect to City's termination for default of a $6 million contract for an addition to its wastewater treatment plant including termination risk assessment, subsequent re-specification, competitive bidding for completion, and related litigation.
- Design Professional Liability. Counsel for Strata (formerly Howard Consultants, Inc.), a geotechnical engineering firm, in important construction litigation case in Washington which established that private property owners do not have the right to sue the developer's consulting engineer for economic loss damages. Carlson v. Sharp, 99 Wn.App. 324, 994 P.2d 851 (1999), rev. denied (2000).
- Diesel Standby Generator, WPPSS No. 2 Nuclear Plant, Hanford, Washington. Representation of Portec, Inc., in suit brought by Washington Public Power Supply System against general contractor and generator manufacturer for damages arising out of claimed defects in design, fabrication, installation, and operation of nuclear plant standby diesel generator.
- Representation of a construction supplier in state court litigation involving over 120 parties and construction lien claims in excess of $1 million.
- Counsel to a contractor in six-day trial in Seattle, Washington, with subcontractor over performance on community college project.
- Counsel regarding surety on bond claims at trial court and Court of Appeals.
- Representation of a contractor on owner claims of construction defects in construction of restaurant.
- Representation of an architect on owner claims of malpractice on design and budgeting for construction project.
