REPRESENTATIVE CLIENTS/TRANSACTIONS
- Represents a number of counties as special deputy prosecuting attorney with respect to condemnation of real property needed for public rights of way.
- Has represented a variety of private owners of commercial, agricultural, and residential properties in Eastern Washington in defense of condemnation actions commenced by the State of Washington, City of Spokane, County of Spokane, Bureau of Reclamation.
- Served as construction counsel to the Spokane Public Facilities District for the construction and equipment procurement for the Spokane Veterans Memorial Arena; and construction of the Convention Center Expansion using the General Contractor/ Construction Manager alternative public works contracting method.
- Represented Idaho municipality as construction counsel with respect to termination by the city of a $6 million contract for an addition to its wastewater treatment plant, subsequent re-specification, competitive bidding for completion, and related litigation.
- Has represented a variety of clients in construction and procurement disputes and litigation including a hospital, residential developers, motel developer, the manufacturer of a diesel standby generator for a nuclear power plant, architectural firm and geotechnical engineering firms.
- Counsel for a geotechnical engineering firm, in an important construction litigation case in Washington which established that private property owners do not have the right to sue the developer’s consulting engineer for economic loss damages. Carlson v. Sharp, 99 Wn.App. 324, 994 P.2d 851 (1999), rev. denied (2000).
- Has provided counseling in product distribution, franchise, and antitrust law, and represented clients in disputes and litigation in a variety of product distribution and franchise industries and businesses, including restaurants and fast foods, hotel/motel, motor vehicles, auto glass repair and replacement, check writing/credit service, miscellaneous manufacturing, industrial minerals, wholesale groceries, carpet, paint and coatings, athletic supplies, railroad ties, soft drinks, specialty coffees, and boat trailers.
- Serves as local counsel to over 190 Washington and Alaska retail pharmacists in price discrimination/antitrust litigation against drug manufacturers, and also has represented pharmacists and construction trade associations in defense of antitrust claims initiated by the State of Washington.
